BIDV Hanoi announces the seizure of collateral

- Based on Civil Code No. 91/2015/QH13 dated November 24th, 2015 of the Socialist Republic of Vietnam;

- Based on Decree of Government No. 163/2006/NĐ-CP dated December 29th, 2006 on secured transactions as amended by Decree of Government No. 11/2012/NĐ-CP dated February 22th, 2012;

- Based on The Resolution No. 42/2017/QH14 dated June 21st, 2017, on pilot settlement of bad debts of credit institution;

- Based on Joint Circular No. 16/2014/TTLT-BTP-BTNMT-NHNN of June 6th, 2014 guiding a number of matters on disposal of security assets;

- Based on The Facility Agreement No. 01/2016/6552820/HĐTD dated December 16th, 2016 between The Joint Stock Commercial Bank for Investment and Development of Vietnam - Hanoi Branch and Bac Viet Production and Trading Joint Stock Company;

- Based on The Apartment Mortgage Agreement No. 3101/2016/HĐTC, book No. 01-TP/CC-SCC/HĐGD dated December 14th, 2016 between The Mortgagee: The Joint Stock Commercial Bank for Investment and Development of Vietnam - Hanoi Branch and The Mortgage: Mr. Lang Van In and Ms. Nguyen Bang Thuong;  

- Based on The working records between The Joint Stock Commercial Bank for Investment and Development of Vietnam - Hanoi Branch and Bac Viet Production and Trading Joint Stock Company;

Considering that the loan hold by Bac Viet Production and Trading Joint Stock Company (The Borrower) at the Joint Stock Commercial Bank for Investment and Development of Vietnam – Hanoi Branch (BIDV Hanoi) has been overdue since April 17th, 2017 but the borrower/secured party did not voluntarily repay the debt, therefore BIDV Hanoi announces the seizure of collaterals as follows:

1. Loans information:

Total outstanding loans of Bac Viet Production and Trading Joint Stock Company at BIDV until July 01st, 2020 details:

- Principal                              : 10.340.200.000 VND

- Interest                                :   5.607.158.150 VND

=> Total amount overdue   : 15.947.358.150 VND

2. Assets information:

Certificate of land use right, housing and other assets attached to land proprietary right No. CE 222019, Number of entry books for land use right certificate CS 28326 issued by Hanoi Department of Natural Resources and Environment dated 12 October 2016. Description of asset:

- Land lot:

+ Address: Golden Palace Apartment, Me Tri Ward, Nam Tu Liem District, Hanoi

+ Land area: 7646,0 m2

+ Form of use: General use

+ Purpose of use: Residential land

+ Time-limit of use: Long term

- House:

+ Apartment: No C3005, Tower C – Golden Palace, Me Tri, Nam Tu Liem, Hanoi

+ Floor area: 338,3m2

+ Form of use: Private use

3. Reason for seizure: Handling collateral to recover debts as agreed in the Mortgage Contract and according to the provisions of law.

4. Time of seizure: July 22th, 2020 until the completion of the seizure.

5. Place of seizure: At the location of the property

6. Term of seizure: From July 22th, 2020 until the collateral is processed, auctioned off for debt recovery by BIDV Hanoi or until the Borrower fulfills the debt repayment obligation.

7. Security asset handling price: Using valuation results of agencies and organizations with price appraisal function. The cost of hiring valuation agencies and organizations is included in the cost of handling security assets.

8. Handling method: Public auction through a functional auction organization designated by BIDV Hanoi.
