Joint Stock Commercial Bank for Investment and Development of Vietnam – Nam Ha Noi Branch (BIDV Nam Ha Noi) notifies about the selection of a debt auction organization as follows:

1. Debt Information:

1.1. Debtor: Ngoc Linh Company Limited

- Address: No. 381 Giai Phong Street, Phuong Liet Ward, Thanh Xuan District, Hanoi City.

- Business registration certificate No. 0100512315 issued by the Department of Planning and Investment of Hanoi for the first time on December 23, 1993 and registration for the 17th change on March 7, 2011.

- Business lines: Manufacture of handicrafts for export, mineral mining and processing for minerals import and export (except for products banned by the State).

1.2. Outstanding debt as of November 30, 2020:

Total Principal: 2,392,693,356,756 VND, in which:

- Principal outstanding debt: 1,110,066,910,868 VND and 11,887,975.00 USD (equivalent to 276,514,298,500 VND at the exchange rate of 23,260 VND/USD)

- Outstanding debt interest rate and penalty fee: 857,043,298,894 VND and 6,408,806.90 USD (equivalent to 149,068,848,494 VND converted at the exchange rate of 23,260 VND/USD)

1.3. Security property:

- Bac Kan lead-zinc electrolysis plant in Ban Cuon 2 village, Ngoc Phai commune, Cho Don district, Bac Kan province (Land lot No.: (no number), map sheet No. 159a/TNĐ, 159b/TNĐ, area of 643,885.2 m2, private use form: 643,885.2 m2, term of use until September 26, 2057 according to the Certificate of land use rights, ownership of houses and other land-attached assets No. BG119120 issued by the Department of Natural Resources and Environment of Bac Kan province on March 11, 2013), including:

+ Project works (all work items related to or belonged to the Project of Bac Kan Zinc-Lead Electrolysis Plant, including not limited to the Plant, other land-attached assets and other work items of the project), together with buildings, constructions, other properties attached to land and vehicles, machinery, equipment and any other real estate which are built, purchased, upgraded and/ or permanently attached or located or for the Plant’s operations.

+ Material Mines, the right to use and exploit resources of the Raw Materials Mine, the Ore Refinery, all machinery and equipment for the operation of the Plant are installed permanently or temporarily at the factory ( all machines and equipment for the mining of Raw Materials and all machines and equipment for the plant's operation.) .

- The asset is a black Lexus LS 460 car, production year of 2007, the owner is Ngoc Linh Company Limited.

- The right to exploit Bo Lieu lead-zinc mine in Dong Lac commune and Nam Cuong commune, Cho Don district, Bac Kan province is granted to Ngoc Linh Company Limited (license period is from June 2011 to May 2016).

- The right to use 14,500 m2 of land in Lac Hong commune, My Van district (now Van Lam district), Hung Yen province of Ngoc Linh Company Limited (agricultural land, currently it has not been issued land use right certificate).

- The property is the land use right and property on land of Mr. Vu Duc Tuan and Ms. Tran Thi Vui at No. 381 Giai Phong Street, Phuong Liet Ward, Thanh Xuan District, Hanoi City.

2. Deadline for document submission:

Deadline for direct document submission is 05 days from the date of notification (documents submitted by post are timed according to the postmark, provided that BIDV South Hanoi must receive them within 07 days from the date of notification).

4. Selection criteria:

An organization registering to participate in an auction must satisfy the criteria specified in Clause 4, Article 56 of the Property Auction Law and the following criteria:

- There is the function of property auction.

- There is at least 03 years of operation.

- There are at least 03 auctioneers.

- There are at least 03 branches/ representative offices.

5. The registration document includes:

- Corporate legal documents.

- Description of capacity and experience.

- Letter of offer.

- Other commitments of the auction organization (if any).

* Note:

- The registration document shall be expired in default if the auction organization is not auctioned according to law provisions.

- BIDV South Hanoi will send a written notice of the results to the selected auction organization, the entities not notified on the result are understood as not selected, BIDV South Hanoi will not return the application with the entities not selected.
