Joint Stock Commercial Bank for Investment and Development of Vietnam - Song Han Branch (BIDV Song Han) officially announces to organizations and individuals inside and outside the BIDV system interested in the property auction as follows:

1. Auctioned property and the reserve price:

1.1. Auctioned property name:

The land use rights, ownership of house and other property associated with land according to the Certificate of land use rights, ownership of house and properties associated with land No. BI 143325, number in the certificate issuance book: CT12740 issued by the Da Nang People's Committee on April 4, 2012, owned by ECICO Joint Stock Company. Specific property is as follows:

- Purpose of use: Industrial park land 7,694.0 m2

- Expiry date: Until March 25, 2054

- Origin of use: Leasing land from enterprises investing in the industrial park infrastructure

+ Other constructions:

- Constructions name: Workshop + warehouse + guardhouse

- Workshop: 2,605.2 m2

- Warehouse:     53.6 m2

- Guardhouse:     9.0 m2

Note:

- The winning bidder must comply with the decisions of the competent state agency on the shelf life of the auctioned property (if any) and commit to have no any inquiries or complaints.

- The winning bidder of the auctioned property is responsible for paying value added tax in case the reserve price does not include value added tax and the auctioned property is subject to value added tax as prescribed; pays registration fees and notarization fees.

- 01 working day prior to the opening of auction, the judgment debtor has the right to regain his/her property if he/she has fully paid the judgment enforcement fee and paid actual and reasonable expenses arising from the coercive judgment enforcement, the organization of auction.

- The judgment enforcement agency is responsible for handing over the property to winning bidder within 30 to 60 days from the date the winning bidder does fully payment. In case it is necessary to take coercive measures to hand over property or there is a decision to postpone, suspend or terminate judgment enforcement issued by a competent state agency, the time for handing over the property may be extended.

1.2. Total reserve price of the property rounded: 17,234,000,000 VND (Seventeen billion, two hundred thirty-four million dong) that includes:

- The value of the industrial zone’s land use right: 13,849,200,000 VND;

- The value of constructions on land including: (according to Clause 8, Article 4 of Circular 219/2013/TT-BTC dated December 31, 2013 of the Ministry of Finance guiding the implementation of the value-added tax law is not subject to the value added tax);

- Workshop:      3,334,656,000 VND

- Warehouse:          42,880,000 VND

- Guardhouse:           7,200,000 VND

1.3. Origin and legal status of the property: Property is sold for judgment enforcement.

2. Auction application purchase fee: 500,000 VND/application;

3. Bid increment: minimum 40,000,000 VND (Forty million VND per bid increment)

4. Time for application purchase and registration: From April 18, 2023 to the end of May 16, 2023 (during office hours, excluding public holidays);

5. Time, location to view the property: From May 11, 2023 – May 12, 2023 and May 15, 2023 (during office hours); at location where the property is located.

6. Venue for application purchase and auction participation registration: No.287 Nguyen Sinh Sac Str., Hoa Minh Ward, Lien Chieu District, Da Nang City. Tel: 0236.3.625.777.

7. Deposit amount: 3,446,000,000 VND (Three billion four hundred and forty-six million dong) – equivalent to 20% of the reserve price.

8. Deposit payment time for auction participation: from May 16, 2023, May 17, 2023 to before 4:30 PM on May 18, 2023; Payment method: Bank transfer – Customer pays into account No. 2011201363454 of Bao Viet Auction Partnership Company opened at Agribank - Cho Con Branch - South of Da Nang.

Auction participants and the property auction organization could have agreement to replace the deposit with a bank guarantee.

9. Time for payment of property purchase:

a. Within no more than 30 days from the date of successful auction, the winning bidder of the auctioned property must fully pay 100% of the property purchase amount to account number 3949.0.1054137,00000 of the Da Nang’s Civil Judgment Enforcement Department that opened at the Da Nang State Treasury after deducting the prescribed deposit and not being extended.

b. If it exceeds 30 days from the date of successful auction, and the winning bidder of the auctioned property fails to make full payment for the purchase of the property, it will be considered a breach of payment obligation and fall into the case of refusal to purchase the property, the deposit amount submitted by winning bidder will be processed as regulated.

10. Registration method for the auction participation: Buyers purchase application, submit application and register directly at Bao Viet Auction Partnership Company. If you yourself do not purchase/submit the application, you may authorize someone else to purchase/submit the application and/or participate in the auction within the specified time in this notice.

11. Time and location of the auction:

Time: At 09:30AM on May 19, 2023

Location: No.287 Nguyen Sinh Sac Street, Hoa Minh Ward, Lien Chieu District, Da Nang City.

12. Auction form:  Directly voting at the auction.

13. Auction method: Ascending-price auction in which auction participants bid from low to high price until the highest bidder that is determined compared to the reserve price as the winning bidder.
